Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Travobear mobile application and related services (collectively, the "Service") operated by Xense Limited ("Xense", "we", "our", or "us"), a company incorporated in Hong Kong SAR. By using the Service, you agree to be bound by these Terms.

1. Eligibility & accounts

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction, whichever is higher) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Your content

You retain all rights in the content you submit to the Service (itineraries, photos, journals, notes, etc.). By submitting content, you grant Xense a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content solely to operate and improve the Service. You represent that you have the rights necessary to grant this licence.

3. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes;
• Upload content that infringes intellectual property, privacy, or other rights;
• Attempt to reverse engineer, probe, or disrupt the Service or its infrastructure;
• Use automated means to scrape, harvest, or extract data without permission;
• Impersonate any person or misrepresent your affiliation.

4. AI-generated content

Itineraries, recommendations, and other suggestions generated by AI models are provided for inspiration and convenience only. They may be inaccurate, incomplete, or out of date. You are solely responsible for verifying information (e.g. visa rules, opening hours, safety advisories) before relying on it.

5. Bookings & third-party services

Travobear may link to or surface third-party services (e.g. booking platforms, mapping services). We are not a party to any agreement you enter with those services, and we are not responsible for their availability, content, or conduct.

6. Intellectual property

The Service, including its software, design, and trademarks, is owned by Xense or its licensors and is protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights are granted to you.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the maximum extent permitted by law, Xense and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to us in the twelve months before the claim, or (b) HKD 500.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

10. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

11. Governing law & disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. The courts of Hong Kong have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service.
